1. general information about the website, access and acceptance

Through the website, Cerveja Independente Musa, Lda provides Users with general information about the company and the products it sells.

By starting to browse, the User accepts these Terms and Conditions of Use, and by their acceptance the User signifies:

  1. That it has read, understood and comprehended the contents of this document;
  2. Who is of legal drinking age according to the rules of the country where the sailing will take place. As provided for in Decree-Law No. 50/2013 of April 16 for individuals in Portugal.
  3. Who is an individual of sufficient age and capacity to be able to hire;
  4. That it assumes all the obligations set out herein.

The use of the website attributes the condition of User of the same and implies acceptance of all the terms included in these general conditions.

Users should read these general terms and conditions carefully each time they access the website, as they may change.

The owner of the website is not responsible for any health damage that may be caused by the incorrect and improper use of the products sold on the website.

2. Conditions of use

2.1 Access to the website

Access to the website is free of charge, except for connection costs via the telecommunications network provided by the supplier contracted by the User.

2.2 Need to register

You may use the Content displayed or disseminated on the Site for exclusively personal purposes, via the Internet, under the other terms set out in these Conditions.

In general, in order to access the services and contents of the website, it will not be necessary for the User to register. However, you may choose to register in advance in order to access the website more conveniently.

The data entered by the User must always be accurate, current and real. The registered User will always be responsible for the security of their password and will therefore be liable for any damages that may arise from its improper use, as well as from its termination, disclosure or loss. To this end, access to restricted areas and/or the use of services and content carried out under the password of a registered User will be considered to have been carried out by said registered User, who will have to answer, in any case, for said access and use.

2.3 Website Usage Rules

The User is obliged to use the website, all its content and services, in accordance with the provisions of the law, morality and public order and these general conditions. They are also obliged to make appropriate use of the services and/or contents of the website, without using them to carry out activities that are illegal or constitute a crime that infringe the rights of third parties and/or that infringe the regulations on intellectual and industrial property, or any other applicable legal rules.

The User is obliged not to transmit, introduce, disseminate or make available to third parties any type of material and information (data, content, messages, drawings, sound and image files, photographs, software, etc.) that are contrary to the provisions of the law, morality and public order and these general conditions. with a restrictive character, and in no case limiting. The User undertakes to:

I. Not to introduce or disseminate content or advertising of a racist, xenophobic, pornographic nature, in support of terrorism or any other content that violates human rights.

II. Not to introduce or disseminate on the network, data programs (viruses and harmful software) that could damage the computer systems of the access provider, its suppliers, or third party Users of the Internet network. 

III. Not to disseminate, transmit or make available to third parties any type of information, element or content that could violate the fundamental rights and public freedoms recognized in the constitution, as well as in international treaties.

IV. Not to disseminate, transmit or make available to third parties any type of information, element or content that constitutes illicit or unfair advertising.

V. Not to transmit unsolicited or authorized advertising, advertising material, spam, "chain emails" or any other form of solicitation, except in areas (such as commercial spaces) that have been exclusively designed for this purpose.

VI. Not to introduce or disseminate any false, ambiguous or inaccurate information or content that misleads the recipients of the information.

VII. Not to supplant other Users by using their registration passwords in the different services and/or contents of the website.

VIII. Not to disseminate, transmit or make available to third parties any type of information, element or content that would constitute an infringement of the intellectual and industrial property rights, patents, trademarks or copyrights belonging to the owners of the website or to third parties.

IX. Not to disseminate, transmit or make available to third parties any type of information, element or content that would constitute a violation of communications secrecy and data protection legislation.

2.4 Exclusion of liability

The User's access to the website does not imply any obligation on the part of Cerveja Independente Musa, Lda. to control the absence of viruses or any other harmful computer element. 

Cerveja Independente Musa, Lda. is not responsible for any damage caused to the software and computer equipment of Users or third parties during the use of the services offered on the website.

Cerveja Independente Musa, Lda shall not be held liable for damages of any kind caused to the User by failures in the telecommunications networks which result in the suspension, annulment or interruption of the website service during the provision of the same or prior thereto.

Information from third parties is an expression of the personal opinions of those third parties. Cerveja Independente Musa, Lda. is not responsible or liable for such information.

2.5 Intellectual and Industrial Property

Unless otherwise stated, all intellectual property rights on the website are the property of Cerveja Independente Musa, Lda. or third parties, including, but not limited to, texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound content, as well as its graphic design and source codes.

Trademarks, trade names or logos are the property of Cerveja Independente Musa, Lda. or third parties, and access to the website should not be construed as conferring any rights over them.

By accepting these general conditions, the User assigns to Cerveja Independente Musa, Lda. free of charge and on an exclusive basis, all rights to exploit the articles, comments and opinions published by the User.

The User, who claims to have all the intellectual property rights to the articles, comments and opinions referred to above, is obliged to assume any claim or liability, including compensation for damages, that a third party may execute against Cerveja Independente Musa, Lda. for considering its rights infringed by any action derived from the obligations that the User contracts, directly or indirectly, with these general conditions. 

3. Terms of engagement

3.1 Images and Product Availability

If you find any errors, please let us know so that we can correct them as quickly as possible for the benefit of all users. Likewise, if you purchase any product on this page, we advise you to check that the name of the product is the one you want. All product orders are subject to availability.

3.2 Purchasing procedure

The procedure for buying products through the online store is as follows:

  1. Start the process by selecting the product you want to buy and then clicking on the "add to cart" button;
  2. After confirming the products and quantities in the cart, the User must click on "Checkout";
  3. Users can proceed with the purchase without having to register on the website. Simply enter your address so that your order is received correctly. If an invoice is required, you will need to enter your Tax Identification Number (NIF) here. Then click on the "Continue to Shipping" button;
  4. Select the type of shipment you want and click on "Proceed to Payment";
  5. Choose one of the following payment methods: Paypal, Credit Card, MB Way or Multibanco.
  6. Due to invoicing issues, if the User realizes that they wish to receive an invoice then they will have to go back to "Contact Information" and enter their NIF - Physical Identification Number, if they have not done so in step 3. Click again on "Checkout" and choose the billing address option.
  7. Finally, click on the "Analyze Order" button. The User will receive confirmation that their order has been accepted via an e-mail address provided in advance.

3.3 Prices and payment methods

All prices published on the website, unless otherwise stated, include VAT at the applicable rate. Users must pay for their purchases using Paypal, Credit Card, MB Way or Multibanco.

In the case of payment by Multibanco, the User will receive an email at the address provided with the details for paying for Multibanco services, specifically the Entity, the Amount and the Payment Reference. The order will be processed as soon as confirmation is received that the payment has been made, at which point the delivery time will begin to run.

3.4 Order delivery

The products purchased by the customer may be delivered either by Cerveja Independente Musa, Lda. itself or by an external logistics provider. Shipping costs will be borne by the customer when explicitly communicated before the order is finalized, otherwise they will be borne by Cerveja Independente Musa, Lda.

Orders will be delivered to the delivery address freely designated by the customer on the order form. Cerveja Independente Musa, Lda. will not accept any liability whatsoever when the product is not delivered, either due to inaccurate or false information provided by the customer, or for reasons beyond the control of the delivery service, such as the absence of the recipient. The order will be delivered as soon as possible, up to a maximum of five working days from the date of order confirmation.

3.5 Procedures to be followed when the package is damaged

The customer is obliged to check the condition of their order upon receipt, either in the presence of an employee of Cerveja Independente Musa, Lda or the logistics company that carried out the transportation and delivery. If the customer (e.g. if the wrong reference has been sent) refuses to accept the order, they should indicate the anomalies in as much detail as possible. These observations should be indicated by the customer or recipient of the order in the delivery service employee's guide and communicated to Cerveja Independente Musa, Lda. by emailing loja@cervejamusa.com.

4. Return and Refund Policy

4.1 Right of Free Resolution

The User has the right to freely terminate the contract entered into with Cerveja Independente Musa under these Terms and Conditions, within 14 calendar days, without having to state any reason.

The period for exercising this right of withdrawal ends 14 days after the day on which the User or a third party indicated by the User, other than the carrier, takes physical possession of the products.

In order to exercise their right of withdrawal, the User must notify Cerveja Independente Musa, Lda of their decision to withdraw from this contract via loja@cervejamusa.com and by means of an unequivocal statement.

The User's communication regarding the exercise of the right of withdrawal must be sent before the expiry of the withdrawal period.

4.2 Effects of Free Resolution

In the event of termination of this contract, the User shall be refunded the payments made, without undue delay and in any event no later than 14 days from the date on which Cerveja Independente Musa, Lda was informed of its decision to terminate the contract.

Cerveja Independente Musa, Lda will make the refund using the means of payment expressly agreed with the User.

Cerveja Independente Musa, Lda will only accept returns of intact, complete products, with the packaging in its original condition, which must not be damaged, altered or scratched, accompanied by the respective invoice.

The User will have to bear the direct costs of returning the products.

Cerveja Independente Musa, Lda may withhold reimbursement until it has received the returned products, or until the User provides proof of their dispatch, whichever occurs first.

In the case of an order for products which, by their nature, cannot be reshipped, or are likely to deteriorate, or quickly become out of date, the User cannot freely terminate the contract.

 5. Applicable legislation

These Terms and Conditions shall be governed by and construed in accordance with Portuguese law.
